A schoolgirl told a jury today (Thursday 19 February) that a boy two years above her at a Stirlingshire high school threatened to “physically rape her” unless she performed a sex act on him.

The girl, giving evidence by video link at Falkirk Sheriff Court, said the boy, whom she named as Stuart Cameron, now 17, had walked her home after school before Christmas 2013 and “tried stuff on” when they reached a flights of steps.

She claimed Cameron tried to put her hand down his trousers.

She said: “He was like ‘just do it’, and I was like ‘no’. He tried to get me to go down on him.

“He basically put me in a headlock and pushed my head down. It was quite strong. He just kept saying ‘do it’ and I kept saying ‘no’. I just tried to stand up straight again. I wasn’t actually able to get fully up because of the force down on my neck.

“Then I got up and walked away, but he just picked me up and put me back on the same step.

“He grabbed my wrists and he was trying to get my hands to go down his trousers.

“I just kept saying no.

“He said ‘just do it, or I’ll physically rape you’.

“I was shocked he’d come out with that. I said I’d phone the police, and he said he didn’t care.” The girl, who said she had been wearing her school blazer, tights and a shirt, said she could not remember whether Cameron had been wearing school trousers, or jeans.

She said Cameron then turned round and went home, and so did she.

She said: “I was in shock, confused.” Later, the girl claimed she told her friends what had happened.

She said: “I didn’t want to go to the police because I thought it wasn’t a crime. I thought it wasn’t important.

“I didn’t go to the police, my friends did. We have a police officer at school and my friends went and spoke to him.” But she added: “When he said he would physically rape me, it didn’t sound like he was joking.” The victim agreed with defence solicitor advocate Neil Hay that months before the incident she had sent Facebook messages to Cameron saying that she was going to rape him.

Cameron, of Falkirk, denies sexually assaulting the girl with intent to rape in the alleged incident, which is said to have occurred on 18 December 2013.

Cameron’s defence is one of consent.

The trial will continue tomorrow (Friday).
