A Stirling teen has been told to expect jail time after breaking into a home in Sauchie shortly before Christmas last year.

Scott Montgomery was found sitting on the couch in a house had broken into before jumping out of the living room window.

He was later charged with attempting to punch a police officer and racially-abusing another during his arrest.

The 19-year-old appeared at Alloa Sheriff Court on Thursday (23 April).

Though a former resident of Station Road, Bannockburn, Montgomery has spent the last four months in Polmont for the offences, which took place on 18 December 2014.

He was spotted skulking around the property on Devon Valley Drive on the morning of the offence.

The court heard that a neighbour had roused the teen, who appeared to be intoxicated, before he then ran off into a nearby garden.

A short time later, the homeowner returned home from work and found Montgomery sitting on the living room couch.

When she asked who he was, he replied: “I’ve just come in.” The homeowner then realised her patio door was opened before then challenging him again.

He then said: “I’m just going to leave,” before standing up and heading for the door.

Depute fiscal Claire Bremner said that the complainer made efforts to block his exit while attempting to contact the police.

She said: “The witness stood in front of him to stop him from leaving.

“The accused thereafter made good his escape through the living room window.

“She then called the police and after checking her home she found her bed had been disturbed.

“An Apple phone and charger, valued at around £310 was missing.” Police then traced the accused at a bus stop on Alloa Road, Fishcross, and explained to him he was being detained.

He tried to run off and had to be ‘taken hold of’ by officers.

Ms Bremner said that during the course of his arrest Montgomery became verbally abusive towards police.

He said: “F***ing let me go, f***ing scummy piggy b***ards.” He then swung a punch at one of the constables before being restrained against a marked car and later handcuff on the pavement.

The stolen mobile phone and charger were recovered on his person.

When being transported to the police station, Montgomery continued his verbal tirade and said to one officer: “Shut it you f***ing English Mongol.” His defence agent Alistair Dalling then told the court the court that he though he was being prosecuted for assaulting an officer, his punch did not make contact because he was ‘too drunk to accomplish that’.

Mr Dalling then asked if his client would be allowed his liberty, having been in custody since December 19 of last year.

Sheriff David Mackie denied the application and told the youngster: “You will continue to be remanded and that is because I consider a custodial sentence to be likely in this case, and that it will likely exceed your current period of remand.” In the meantime, the sheriff asked for social work reports to be carried out with Montgomery’s sentencing diet set down for 21 May.
