A drink driver who was three times over the limit “foolishly” got behind the wheel to get a takeaway.
On Thursday at Alloa Sheriff Court, John Bowman admitted driving on the A907 and Stirling Road in Tullibody with 70 microgrammes of alcohol in 100 millilitres of breath, which exceeded the legal limit of 22mg, on January 6, 2016.
Fiscal depute Ruairidh Ferguson told the court that Bowman, of Millhall in Stirling, was stopped by police after they spotted him speeding up and slowing down for no reason.
The 49-year-old failed the roadside test and was thereafter taken to Stirling Police Station where he admitted he’d had a drink earlier.
Defence agent Lara Thomson stated that her client had no record and a clean driving license.
She explained that Bowman was at home that evening and had a drink.
He wanted a takeaway and didn’t have a number, so “foolishly” got in the car.
She said: “He’s very upset he’s found himself in this situation at this age.”
Sheriff Gillian Wade disqualified Bowman from driving for one year and fined him £450.
